This Privacy Policy explains how DARKHORSEIQ LLC collects, uses, discloses, stores, and safeguards information when you use the DarkHorseIQ application, website, and related services.

By accessing or using the Service, you acknowledge that you have read this Privacy Policy and understand how your information may be collected, used, shared, retained, and deleted as described below.

1. Interpretation and Definitions

For purposes of this Privacy Policy, the following terms have the meanings set out below.

The DarkHorseIQ mobile application and related digital properties provided by the Company.

The Application, website, and associated services, features, and tools.

Data collected automatically through operation of the Service or supporting infrastructure.

The individual or entity accessing or using the Service.

2. Information We Collect

2.1 Sources of Collection

We may collect information:

  • Directly from you when you create an account, complete a profile, contact support, join a waitlist, or submit content.
  • Automatically when you use the Service, including through device, analytics, diagnostic, and log data.
  • From your activity within the Service, such as gameplay, rankings, court discovery, tournament participation, and social features.
  • From service providers that support authentication, hosting, analytics, communications, security, and notifications.

2.2 Information You Provide Directly

We may collect information you submit when creating or using an account, including:

  • Email address.
  • Name, username, or display name.
  • Profile information, such as profile photo, skill level, and general location information such as city or state.
  • Communications you send to us, including support requests, feedback, or account-related inquiries.

2.3 Gameplay and Activity Data

Because DarkHorseIQ is a sports performance platform, we may collect:

  • Match scores and results.
  • Player statistics and performance metrics.
  • Leaderboard rankings and XP progression.
  • Participation history for games, events, and tournaments.

2.4 Device and Usage Data

We may automatically collect technical and diagnostic information, including:

  • IP address.
  • Device type and operating system version.
  • App usage data, such as screens viewed and time spent.
  • Crash logs, diagnostics, and unique device identifiers.

2.5 Media and Camera Data

With your permission, we may access or collect photos or videos, for example for profile pictures or other media features available in the Service. You may revoke this access through your device settings. If you choose not to grant access, some features may be unavailable.

2.6 Location Data

We may collect approximate location information, such as city or state, in order to:

  • Show nearby courts.
  • Enable local leaderboards.
  • Improve matchmaking and other localized features.

We do not collect precise GPS location unless specifically disclosed and authorized by you.

2.7 Payment and Transaction Data

The Service does not currently process paid subscriptions, in-app purchases, or direct payment card transactions.

If paid features are introduced in the future, we will update this Privacy Policy before collecting related transaction or subscription information.

3. How We Use Your Data

We may use collected information for the following business and operational purposes:

  • Provide and maintain core Service functionality, including match tracking, scoring, and leaderboards.
  • Personalize your account experience, progression systems, rankings, and recommendations.
  • Improve Service performance, features, usability, and reliability.
  • Operate social features such as player profiles, discovery, and interactions.
  • Send notices, reminders, and product-related communications.
  • Detect, prevent, and investigate fraud, abuse, misuse, or security incidents.
  • Provide customer support.
  • Comply with legal obligations and enforce our terms.

4. AI Features and Analytics

The Service does not currently use AI-powered features to collect or process user content for coaching or analysis.

If AI-powered features are introduced in the future, we will update this Privacy Policy before those features become active and describe what information is processed, how it is used, and whether any third-party providers are involved.

5. Sharing of Your Data

We do not sell your Personal Data. We may disclose information in the limited circumstances described below.

5.1 Service Providers

We may use trusted vendors and infrastructure partners to operate the Service, including providers for authentication and databases, hosting, analytics, crash reporting, customer communications, notifications, and security. This may include providers such as Supabase where used. These providers process information on our behalf and subject to contractual or operational restrictions.

5.2 Public and Social Features

When you use profile, leaderboard, or other social features, certain information such as your profile, stats, rankings, or content you choose to share may be visible to other users.

5.3 Business Transfers

If the Company is involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction.

5.4 Legal and Safety Disclosures

We may disclose information if required by law or if reasonably necessary to protect rights, safety, prevent fraud, or respond to lawful process.

5.5 No Sale of Personal Data

We do not sell personal information for money. If our practices change, we will update this Privacy Policy before doing so.

6. Data Retention

We retain information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including to meet legal, operational, and dispute-resolution requirements.

  • Account data may be retained while the account is active and for up to 24 months following deletion.
  • Gameplay and performance data may be retained to preserve match history, rankings, and statistical continuity unless deleted or anonymized.
  • Analytics, logs, and support-related records may be retained for up to 24 months.

We may retain data longer where required by law or where necessary to establish, exercise, or defend legal claims. We may also retain limited backup copies for business continuity and disaster recovery for a temporary period. We may anonymize or de-identify certain data for analytics and product improvement.

7. Your Rights

Subject to applicable law and your location, you may have the right to:

  • Access the personal information associated with your account.
  • Update or correct inaccurate information.
  • Request deletion of your account and associated data.
  • Request an export of your data.
  • Object to or restrict certain processing where permitted by law.
  • Withdraw permissions for camera, photos, notifications, or location through your device settings.
  • Opt out of non-essential marketing communications by using the unsubscribe method in those messages, where applicable.

You may exercise these rights through available in-app settings or by contacting [email protected]. We may take reasonable steps to verify your identity before processing certain requests.

8. Account Deletion

You may request deletion of your account by using in-app settings, where available, or by contacting support at [email protected].

Following a verified deletion request, personal data will be removed from active systems within a reasonable period, although certain information may remain temporarily in backup systems or where retention is required for legal, security, fraud-prevention, accounting, or operational reasons.

Some content associated with rankings, match history, or community features may be deleted, de-identified, or retained in aggregate form where necessary to preserve the integrity of the Service.

9. Data Security

We implement reasonable administrative, technical, and organizational safeguards intended to protect information, including secure authentication controls, encrypted transmission where appropriate, and access restrictions.

Information may be processed and stored in the United States or other jurisdictions where we or our service providers operate. No method of transmission over the internet or method of storage is completely secure, and we cannot guarantee absolute security.

10. Children's Privacy

The Service is not intended for children under 13. We do not knowingly collect personal information from children under 13. If we become aware that such information has been collected, we will take reasonable steps to delete it.

12. Changes to This Policy

We may revise this Privacy Policy from time to time. When we do, we may update the effective date above and provide notice through the Service, by email, or through other reasonable means where required. Continued use of the Service after an update becomes effective is subject to the revised Privacy Policy.
